Retail Sale Agreement for Gastronomic Boxes

1. Terms and Definitions

1.1. Offer — This public proposal to conclude a retail sale agreement, addressed to any person who accepts it.

1.2. Acceptance — Full and unconditional acceptance of the Offer terms by placing an order on byshura.ru.

1.3. Goods — Gastronomic boxes and related products presented on the Site.

1.4. Buyer — An individual who places an order and accepts this Offer.

1.5. Seller — Aleksandra Aleksandrovna Nolfina, registered as a taxpayer of professional income (self-employed), TIN 501006570884, operating in compliance with UAE and Russian Federation legislation.

2. Subject of Agreement

2.1. The Seller undertakes to deliver the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods under the terms of this Offer.

2.2. The agreement is considered concluded from the moment the Buyer accepts the Offer (by placing an order).

Important: Placing an order on the Site means the Buyer has read and agreed to all terms of this Offer.

3. Order Procedure

3.1. Orders are placed through the Site by filling out the order form and selecting delivery/pickup options.

3.2. After order placement, the Seller contacts the Buyer for confirmation within 1 hour during working hours (Fri-Sun 17:00–23:00).

3.3. The Seller reserves the right to cancel an order if:

  • The product is out of stock;
  • The Buyer does not confirm the order within 2 hours;
  • Errors are found in delivery details.

3.4. In case of cancellation, the Seller notifies the Buyer and refunds any prepaid amount in full.

4. Price and Payment

4.1. Prices for Goods are displayed on the Site in UAE Dirhams (AED).

4.2. Payment methods:

  • Online payment via secure payment gateways;
  • Cash on delivery;
  • Bank transfer (upon agreement).

4.3. Delivery costs:

  • Pickup from designated location — Free;
  • Courier delivery within Dubai — 40 AED (or calculated individually based on distance).

5. Delivery and Receipt

5.1. Delivery is provided via:

  • Courier to the Buyer's specified address;
  • Pickup from the designated point in Dubai (address provided upon order confirmation).

5.2. Delivery time is coordinated with the Buyer during order confirmation.

5.3. Upon receipt, the Buyer is obliged to:

  • Check the packaging integrity and order completeness;
  • Confirm receipt by signing the courier's device or providing an SMS code.

5.4. If the Buyer is unavailable at the agreed time, delivery is rescheduled or cancelled by mutual agreement.

6. Return and Exchange

6.1. In accordance with UAE Consumer Protection regulations, food products of proper quality are not subject to return or exchange.

6.2. If defects are discovered (damage, non-compliance with description), the Buyer has the right to:

  • Request a replacement with an equivalent product;
  • Request a proportional price reduction;
  • Refuse the contract and demand a full refund.

6.3. Quality claims are accepted within 24 hours of receipt via email: saschhen@gmail.com with photo/video evidence.

7. Liability of Parties

7.1. The Seller is not liable for:

  • Inaccurate information provided by the Buyer;
  • Delivery delays caused by courier services or force majeure;
  • Technical failures on the Site beyond the Seller's control.

7.2. The Buyer is responsible for the accuracy of contact details and delivery address provided.

8. Force Majeure

8.1. Parties are released from liability for non-performance due to force majeure circumstances: natural disasters, government decisions, pandemics, utility failures, etc.

8.2. The affected party must notify the other party within 3 days of the circumstance occurrence.

9. Dispute Resolution

9.1. All disputes are resolved through negotiation. A pre-trial claim procedure is mandatory.

9.2. If no agreement is reached, disputes are referred to the competent courts of the United Arab Emirates (Dubai) in accordance with UAE Federal Law No. 1 of 2006 on Electronic Transactions and UAE Consumer Protection Law.

11. Final Provisions

11.1. This Offer comes into effect upon publication on the Site and remains valid indefinitely.

11.2. The Seller reserves the right to amend the Offer. New versions are published on the Site and take effect 3 days after publication.

11.4. By using the Site and placing orders, the Buyer confirms they have read, understood, and fully agree to these Terms.
